Woman fined for鈥痵ilence鈥痮ver illegal dumping offence鈥

A Hamilton Hill woman has been鈥痜ined鈥$400 and ordered to pay costs of $783.50鈥痜or failing to say who was driving鈥痑鈥痗ar when it was used in an illegal dumping offence.鈥

Belinda Annette鈥疍ella Valle鈥痑ppeared in the Perth Magistrates鈥疌ourt鈥痮n鈥疢onday 12 July 2021.鈥赌&苍产蝉辫;

She鈥痺as charged under section 27(1a) of the鈥疞itter Act 1979鈥 after she failed to provide details about who was driving a Holden Rodeo utility that was photographed in鈥疶orogoyle鈥疪eserve in Wattleup on 6 January 2020.鈥赌&苍产蝉辫;

The鈥痯hotographs showed what appeared鈥痶o be a male person driving the vehicle with a tray full of waste into the area, then leaving shortly afterwards with an empty tray. The waste was鈥痩ater鈥痙iscovered by鈥疍epartment of Water and Environmental Regulation inspectors.鈥赌&苍产蝉辫;

Ms鈥疍ella Valle鈥痺as in possession of the鈥痸ehicle鈥痑t the time鈥痑nd鈥痺as required under the鈥Litter Act鈥1979鈥&苍产蝉辫;to provide details of鈥痶he person鈥痺ho was鈥痙riving鈥痶he vehicle鈥痑t the time of the offence.鈥赌&苍产蝉辫;

DWER鈥痑cting Senior Manager Waste Operations, Cliff Bliss, said鈥痯eople鈥痺ere鈥痳equired by law to supply information about who was driving a car when it鈥痺as鈥痷sed to commit an offence.鈥赌&苍产蝉辫;

鈥淚n this case the offender could have avoided a penalty by simply supplying information about who was driving at the time鈥痮f the offence,鈥 Mr鈥疊liss鈥痵aid.鈥赌&苍产蝉辫;
